1. Scope of Agreement

本协议适用于元气健康软件及相关服务。您通过 App Store 等应用商店下载并使用本软件，即表示您同意接受本协议的所有条款。

This agreement applies to the Vitality Health software and related services. By downloading and using the Software through app stores such as the App Store, you agree to accept all terms of this agreement.

• 出租、租赁、出借、转售、分发本软件或基于本软件创造衍生产品
• 移除、规避或破坏本软件中的任何技术限制或安全机制

• Copy, modify, decompile, disassemble, or otherwise attempt to discover the source code of the Software
• Rent, lease, lend, resell, distribute, or create derivative works based on the Software
• Remove, circumvent, or destroy any technical limitations or security mechanisms in the Software

• 遵守所有适用的法律法规
• 不使用本软件从事任何违法或不当行为
• 不干扰或破坏本软件的正常运行
• 对您的使用行为负责
• 在使用血谱测量功能时，确保您拥有使用该功能的合法权利
• 理解并同意血谱测量结果仅供参考，不能替代专业医疗建议或临床诊断
• 理解本应用不使用面部识别数据（Face ID/TrueDepth API）进行身份验证或唯一身份识别
• 理解摄像头仅用于捕获面部皮肤颜色的微小变化以提取血谱信号，不获取、不存储面部特征点，且无法用于识别特定个人身份
• 如发现不当内容，及时向我们报告并配合处理

• Comply with all applicable laws and regulations
• Not use the Software for any illegal or improper activities
• Not interfere with or disrupt the normal operation of the Software
• Be responsible for your usage behavior
• When using blood spectrum measurement features, ensure you have legal rights to use such features
• Understand and agree that blood spectrum measurement results are for reference only and cannot replace professional medical advice or clinical diagnosis
• Understand that this app does not use facial recognition data (Face ID/TrueDepth API) for authentication or unique identity identification
• Understand that the camera is only used to capture tiny changes in facial skin color to extract blood spectrum signals, does not obtain or store facial feature points, and cannot be used to identify specific individual identities
• Report inappropriate content to us promptly and cooperate in handling such matters

本软件的所有知识产权（包括但不限于商标、专利、著作权、商业秘密等）均归我们所有。未经我们明确书面许可，您不得使用、复制或传播这些内容。

All intellectual property rights in the Software (including but not limited to trademarks, patents, copyrights, and trade secrets) belong to us. You may not use, copy, or distribute these contents without our explicit written permission.

• 所有血谱测量数据（包括分析结果）仅存储在您的手机本地设备上，不会上传到服务器
• 我们仅在您的设备本地处理人脸数据，不会上传您的人脸照片或任何面部图像数据到服务器
• 我们的血谱测量算法和健康数据分析模型受知识产权保护
• 如权利人认为其数据或隐私权受到侵犯，请通过以下方式联系我们，我们将按照"通知-删除"原则及时处理
• 我们保留在收到有效侵权通知后删除相关内容的权利
• 我们鼓励用户仅使用自己的数据进行测量

• We only serve as a technical service platform, providing users with technical tools for camera-based blood spectrum measurement
• All blood spectrum measurement data (including analysis results) is stored only on your mobile device locally and will not be uploaded to the server
• We only process facial data locally on your device and do not upload your facial photos or any facial image data to the server
• Our blood spectrum measurement algorithms and health data analysis models are protected by intellectual property rights
• If rights holders believe their data or privacy rights are infringed, please contact us through the following methods, and we will handle it promptly according to the "notice-and-takedown" principle
• We reserve the right to remove related content after receiving valid infringement notices
• We encourage users to only use their own data for measurement

• All defects will be fixed
• Accuracy and reliability of blood spectrum measurement results
• Blood spectrum measurement results do not constitute medical advice or clinical diagnosis basis
• This app is not a medical device, and measurement results are for reference only
• Blood spectrum measurement features will not be affected by technical issues
• We are not responsible for risks caused by improper use by users

6. 服务变更、中断或终止

6. Service Changes, Interruption, or Termination

我们保留在以下情况下修改、中断或终止服务的权利：

We reserve the right to modify, interrupt, or terminate the service under the following circumstances:

• 根据法律法规要求
• 维护或升级软件
• 不可抗力因素导致的服务中断
• 其他我们认为必要的情况

• As required by laws and regulations
• For software maintenance or upgrades
• Service interruption due to force majeure
• Other circumstances we deem necessary

7. 退款政策

关于App内购买项目的退款：

Regarding refunds for in-app purchases:

• 所有退款申请需通过 Apple App Store 处理
• 当您向 Apple 发起退款申请时，我们将向 Apple 提供您的产品使用记录（如功能使用时长、使用频率等数据），作为评估退款申请的参考依据
• 最终退款决定权在 Apple
• 如退款申请获得批准，相关功能的使用权限将被收回

• All refund requests must be processed through the Apple App Store
• When you submit a refund request to Apple, we will provide Apple with your product usage records (such as feature usage duration, frequency, etc.) as reference for evaluating the refund request
• Apple has the final decision on refunds
• If the refund request is approved, access to the related features will be revoked

8. 协议修改

8. Agreement Modifications

我们保留随时修改本协议的权利。修改后的协议将在软件内或通过其他方式公布。继续使用本软件即表示您接受修改后的协议。

We reserve the right to modify this agreement at any time. The modified agreement will be published within the Software or through other means. Continued use of the Software indicates your acceptance of the modified agreement.

9. 适用法律

本协议受香港特别行政区法律管辖并按其解释。与本协议有关的任何争议，双方应友好协商解决。

This agreement is governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any disputes related to this agreement shall be resolved through friendly negotiation between both parties.
